RNP under 44-FZ and 223-FZ: Key Differences, Risks, and Legal Pitfalls

Why can't we treat the 44-FZ and 223-FZ RNPs equally?

One of the most common business mistakes is to assume that the Register of Unreliable Suppliers (RUS) under 44-FZ and 223-FZ works according to the same logic.
Formally, it is one institution.
In fact, there are two different legal regimes with different levels of risk.
Failure to understand these differences can lead to mistakes in defense and strategy.

1. General logic of the RNP: what is the same

Regardless of the law:
  • the register is maintained by the antimonopoly authority;
  • the stay period is up to 2 years;
  • supplier behavior is evaluated;
  • the decision is made by the regulator's commission.
The procedure is administered by the Federal Antimonopoly Service. This is where the similarities end.

2. Key differences between the 44-FZ and 223-FZ RNP

Criteria

223-FZ
Regulation
Strictly by law

Formalism

Moderate, but variable
Customer's role
Restricted by law
Significantly wider
Flexibility of the procedure
Minimal cost
High
Supplier's risks
Straight
Often hidden
Conclusion:
223-FZ gives the customer more flexibility — and more uncertainty for the supplier.

3. RNP under 44-FZ: Formalism and Zero Tolerance

Limited version
The 44-FZ RNP is a regime of minimal discretion. Even a minor mistake can have fatal consequences.

4. RNP under 223-FZ: Flexibility that is Dangerous

According to 223-FZ, the key role is played by the customer's procurement regulations.

The danger of 223-FZ is not in formalism, but in unpredictability.

7. How does the FAS view Federal Laws 44-FZ and 223-FZ?

Diagram 1. Controller logic
44-FZ:
Fact of violation → procedure check → decision
223-FZ:
Procurement conditions → behavior of the parties → assessment of integrity → decision
The FAS is more likely to show greater flexibility in 223-FZ cases, but also greater requirements for argumentation.

8. Practical conclusion for business

Type of business
Key risk
Construction
Terms and volumes
Fuel and ENERGY COMPLEX
Quality and subcontracting
Infrastructure
Unilateral refusal
Corporate purchases
Purchase regulations
👉 RNP under 223-FZ is often more dangerous than under 44-FZ, precisely because of the illusion of flexibility.

9. Main conclusion

RNP under 44-FZ and 223-FZ:
  • they have different legal nature in practice;
  • they require different security strategies;
  • they do not tolerate universal solutions.
Companies that understand this are much less likely to be included in the register.
